As you know, the final version of the “three strikes” anti-piracy code for Australian internet service providers (ISPs) has been published recently. Under the Copyright Notice Scheme code (PDF), residential Internet users that are found pirating content will be subject to a series of "escalating" warning notices from rights holders, sent via ISPs. The notices will warn users that they are infringing copyright, and that they will face legal action if they get three strikes recorded against their IP address - that is, if they receive an Education, Warning and Final notice - within a 12 month period. If a user gets three warning letters, or "strikes", in a 12-month period, ISPs will help copyright owners identify them for potential legal action after a hearing in a prescribed court. Up to 200,000 notices can be processed and sent each year.

Separate from the anti-piracy, website-blocking regime passed in June, the scheme was designed to warn consumers via notices to stop pirating or face the prospect of having their personal details handed over to rights holders if they got caught pirating more than three times.

It was originally envisaged that the code would take effect on 1 December. However, the start of the scheme has been delayed and it is now expected on 1 March - accodring to The Sydney Morning Herald

Such regimes are used in many countries and are commonly known as “three-strikes”. However, they are promoted as educational in nature, because suspected pirates just receive notifications of breach, which are meant to discourage further infringing behavior.

To prevent their IP-addresses from being visible to the rest of the Internet, thousands of Australian internet users have signed up to the VPN services. With a VPN Australians are able to use the Internet anonymously and prevent ISP and Government Agencies from tracking their online activity. VPN services hide real IP address of the users and they don’t log any traffic nor session data of any kind.

No avatarIt wont happen by december 1 as telstra and optus have outright refused to support the scheme saying it will cost them close to $30 in administrative costs per notice sent, and now a further twist, Malcolm Turnbull is now our new prime minister, optus said they need at least $20 from rights holders per notice, for the scheme to become viable. With government forced mandate unlikely in the foreseeable future (because of Malcolm Turnbulls new position in the govenment). The only way for this to work in this country the rights holders will have to contribute to the ISPs costs, now its up to the rights holders and the communication alliance to come to an mutual agreement. This will not happen till at least sometime in 2016.

hopefully it does the trick , aussie government cares more for big buisness revenue than its own citizens !
whether its mining or copyright protection, the amount of moey spent on these hair brain schemes could be better spent on more pressing issues such as education or health ! instead, they are raising taxes to to pay for this immoral attack on personal freedom.

No avatarAAHHHH Freedom, yes I remember them days, its long gone unfortunately but you can get some of it back, ditch the PC and smart phone, for a start, connect back to nature, aaahhh yes Nature where's that gone now, with global warming now considered real. the world is truly an amazing place, would be even more, without humans.

The only thing I really can say with accuracy is this debate is maddening and I see no clear path. But 100-1000 others will each have an absolute answer. And on and on.......turn an 8 on its side.....and on and ...and yet this article keeps appearing in one or another form but the true answer is ...unknown....known.....and on and......

swayzesghost avatarI hope it's not a big deal that I mention this.. seems to be slightly controversial since a lot of people(probably non users) swear it doesn't work, but I was getting notices all the time until I started using Peerblock(ex peerguardian). I don't know if the VPN companies just started a rumor that it doesnt work, but given that I stopped getting letters since using peerblock, I suspect it actually does work if you update the list constantly. Although I don't think it works for certain popular TV shows and music, IDK but I just avoid dling certain super popular tv shows, just in case

isnt it 6 strikes in US? last I checked my cable provider allowed 6 strikes, and that was just to potentially be throttled in speed or potentially lose your service, not have them hand over your info to the copyright holders..

I think I use a similar app called PROTECTII. Maybe it is not well know like peerblock either, but it works fantastic. Protectii works with utorrent only and it works for every kind of torrent out there. It jacks your IP on utorrent and throws bogus ones on the list.

Or maybe we're outing a torrenting secret here...

No avatarI would simply stay poor as I do in USA (I work for cash only = nothing to garnish). Then let them waste their time suing me. If they want to give me free room and board in a cage they can go ahead. Let them do that will a billion torrenters and see if how much they enjoy paying for that (assuming they even can for any length of time worth mentioning, 20% of an entire county's population suddenly in jail will totally throw their entire economy out of whack far more than the few billion in losses from a few IP industries).

All the squabbling between ISPs, rights holders and the government will ensure that nothing is gonna happen in Oz for a good, long while. In the meantime, I'll get all the shows, movies and AK6103's music uploads I can get my hands on, and be happy!
